Explanation. - In this clause, go-slowmeans an organized, deliberate and purposeful slowing down ofnormal output or the deterioration of the normal quality of workby a body of workmen acting in a concerted manner, but does notinclude the slowing down of normal output or the deterioration ofthe normal quality, or work which is due to mechanical defect,break-down of machinery, failure or defect in power supply or inthe supply of normal materials and spare parts of machinery.

(3) Where a settlement is notreached between the employer and the collective bargaining agentor, if the views of the employer or collective bargaining agenthave been communicated under sub-section (1) to the Works Council,there is a failure of bilateral negotiations in the Work Council,the employer or the collective bargaining agent may, within sevendays from the end of the period referred to in sub-section (2),serve on the other party to the dispute a notice of lock-out orstrike, as the case may be, in accordance with the provisions ofthis Ordinance.

55. Penalty for failing toimplement settlement, etc. - Whoever wilfully fails toimplement any term of any settlement, award or decision which itis his duty under this Ordinance to implement, shall bepunishable with imprisonment for a term which may extend to oneyear, or with a fine which may extend to rupees five hundred orwith both, and, in the case of continuing failure, with a furtherfine which may extend to two hundred rupees for every day afterthe first during which the failure continues.

62. Penalty for otheroffences. - Whoever contravenes, or fails to comply withany of the provisions of this Ordinance, shall, if no otherpenalty is provided by this Ordinance for such contravention orfailure, be punishable with fine which may extend to two hundredand fifty rupees.
